Terms of Service

These Terms of Service (“Terms”) govern your access to and use of nomaflow, including its website, voice journaling, and journal features (the “Service”). The Service is operated by Foster Burgess, LLC (“Foster Burgess,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

Who may use the Service

You must be at least 18 years old to use the Service. You agree to provide accurate account information and keep your sign-in credentials secure. Phone calling features are available only to users based in the United States or Canada. To receive calls, you must verify a phone number that belongs to you or that you are authorized to use.

The Service and AI features

nomaflow lets you create journal entries by speaking on a call, using the website voice interface, or typing. Voice and text content may be processed to create a transcript, summary, title, or reflection. Voice sessions may be recorded and saved so you can review them. Audio and journal content may be sent to Telnyx and AI service providers, including OpenAI, to provide these features. See the Privacy Policy for details about providers, retention, and deletion.

AI-generated responses, summaries, and transcripts may be incomplete, inaccurate, inappropriate, or misleading. They may not be reviewed by a qualified professional. Do not rely on them to make important decisions.

Important: Not medical, health, therapy, or emergency support

nomaflow is a journaling service only. It is not intended to provide medical advice, health advice, diagnosis, treatment, therapy, psychotherapy, counseling, clinical care, crisis intervention, or any other medical, mental-health, or health-related support.

Nothing in the Service, including any AI conversation, recording, transcript, summary, or reflection, is professional advice or a substitute for care from a qualified health professional. Use of the Service does not create a doctor-patient, therapist-client, or other professional relationship. The Service and its AI may not recognize a crisis or emergency and may provide inaccurate or inappropriate responses.

Do not use the Service to diagnose or treat a condition, make decisions about health care or medication, or seek crisis or emergency help. Do not delay or disregard professional advice because of something provided by the Service. For medical or mental-health needs, contact a qualified health professional. In an emergency or immediate danger, contact local emergency services.

Your content and other people’s information

You retain your rights to the journal content you submit. You give us permission to host, store, transmit, transcribe, summarize, and otherwise process that content as needed to provide, secure, and support the Service. Our service providers may process it on our behalf as described in the Privacy Policy.

Use voice features only for content you have the right to share. If another person’s voice or personal information is included, you are responsible for giving them any notice and obtaining any permission required before recording or sharing it.

Your account and acceptable use

You are responsible for activity under your account and for keeping your account information current. You may not misuse the Service, interfere with its operation or security, attempt to access another person’s account or data, or use the Service in violation of law or another person’s rights.

You can delete journal entries and recordings in the Service and may request account deletion. Deletion timing and backup copies are described in the Privacy Policy.

Fees and changes to the Service

The Service is currently free. We may introduce paid features in the future. If a feature will require payment, we will show you the applicable price and terms before charging you. You may choose not to use that paid feature.

We may change, suspend, or discontinue parts of the Service. We may suspend or terminate access if you materially violate these Terms, create a security risk, or if we are required to do so by law.

Third-party services

The Service depends on third-party providers, including phone carriers, hosting, email, social sign-in, and AI providers. Those services are governed by their own terms and may be unavailable or outside our control. Phone calls pass through telephone networks that we do not operate.

Disclaimers and limits

To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. To the extent permitted by law, Foster Burgess will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Nothing in these Terms limits rights or remedies that cannot legally be limited.

Governing law and updates

These Terms are governed by the laws of North Carolina, without regard to conflict-of-law rules, except where applicable law requires otherwise. Any court proceeding relating to these Terms must be brought in a court with jurisdiction in Wake County, North Carolina, unless applicable consumer law gives you another venue.

We may update these Terms as the Service changes. We will post the current version here and update the date above. If a change requires additional notice or consent, we will provide it as required by law. Continued use after an update means the updated Terms apply to the extent permitted by law.
